TERMS AND CONDITIONS

**GUNYATE operate strictly under the laws and regulations of the DIAMOND ACT 56 OF 1986

"diamond exchange" means any premises upon which any person permitted in terms of this Act to sell or purchase an unpolished diamond may sell or purchase the unpolished diamond;

"licensee" means a dealer, cutter, tool-maker or researcher;

"exporter", in relation to an unpolished diamond, means any person permitted in terms of this Act to export the unpolished diamond;

"polished diamond" means a diamond which has, in accordance with the requisites of its class or form, been subjected to so many processes of polishing that it is inthe opinion of the Board a polished diamond;

"producer" means any person who is in terms of the Minerals Act, 1991, entitled to win or recover diamonds;  [Definition of "producer" substituted by s. 1 (b) of Act 10 of 1991.]

"purchase", in relation to an unpolished diamond, means to purchase the unpolished diamond, to deal in it or to obtain it by way of barter, pledge or in any like manner;

"regulation" means a regulation made under section 95 (1)

"this Act" includes a regulation;

"unpolished diamond" means a diamond in its natural state or a synthetic diamond which has after the production thereof not been altered in any manner, and includes diamond powder, a crushed diamond, a fragment and a partly processed diamond.

**All Transactions should comply with the KPCS system meaning:  "any import/export of unpolished diamonds must be accompanied by a certificate that proves the originality of the diamonds and / or that the diamonds are conflict free."  - KIMBERLY PROCESS CERTIFICATION SCHEME

Participating countries are:  Angola, Armenia, Australia, Belarus, Botswana, Brazil, Bulgaria, Canada, Central African Republic, China, Congo, Democratic Republic, Cote D' Ivoire, Croatia, European Community, Ghana, Guinea, Guyana, India, Israel, Japan, Korea, Lao, Lesotho, Malaysia, Mauritius, Namibia, Norway, Romania, Russian Federation, Sierra Leone, Singapore, South Africa, Sri Lanka, Switzerland, Tanzania, Thailand, Togo Ukraine, United Arab Emirates, United States of America, Venezuela, Vietnam and Zimbabwe.

**GUNYATE will assist so the following will apply on all transactions:  "The licensee may when viewing or purchasing unpolished diamonds on a premises approved in terms of Section 48(1)(d) (selling office), or a premises approved in terms of section 48 (2) (buying office), only be assisted by another licensee or a nutural person registered as an authorized representative in terms of Section 54 of the Diamonds Act, 1986"

The above meaning that all the transactions introduced by GUNYATE will take place at a SECURE and licensed office and no transaction will take place in a house, hotel or anywhere else that is not licensed!
